Matthew Moir’s practice encompasses a range of industrial work, mainly focused on employment disputes and work health and safety prosecutions. 

Recently, Matthew has been successful in appeal cases selected for reporting in the Industrial Reports involving whether an employment relationship exists Ace Insurance Ltd v Trifunovski (2013) 235 IR 115, the nature and function of pleadings in criminal charges Lorenzo and Santos v Inspector Hayes (2011) 203 IR 454, the legality of strike action ballot orders under the Fair Work Act Power Projects International Pty Ltd v AMWU & AWU (2011) 210 IR 357 and the liability of company directors for work safety offences Liang v Inspector Farmer (2010) 199 IR 116.

Matthew maintains an active practice in all aspects of employment law including mediations, trials and appeals.  In a recent case, a member of the Fair Work Commission observed that Matthew’s cross-examination was “very useful” and “skilful but respectful”: AMWU v Agilent Technologies Australia Ltd [2014] FWC 2813.

Matthew has appeared in a wide range of jurisdictions, including the High Court, the Federal Court, the Supreme Court, the Industrial Court, the District Court, the Local Court and the Federal Circuit Court.  In recent years, his practice has been largely focused on appearing for prosecutors and defendants in major work health and safety cases.  He also regularly appears in sentence hearings and coronial inquests.

Matthew has published articles in peer reviewed “A+” ranked journals such as the Sydney Law Review and Australian Journal of Labour Law
